I just saw the Nexuiz.com site got a makeover.

Who is illfonic?

What's going on here?

So, it seems illfonic is a developer group, who ported the engine to XBox, and bought the rights to sell the new game under the name of Nexuiz.
Too bad, that we won't benefit anything from this, because imho the media with the new XBox version won't be GPL. At least I would be very much surprised the other way.

Wutt? This is what I expected least. I thought it was something Nexuiz-related. Well, it is, but I mean, in another way. The OTHER Nexuiz.

Is this even legal? In many jurisdictions, a trade mark doesn't necessarily have to be registered for protection, but as far as I know all this usually relates to commercial usage of marks.

I can not say much about the game until it is out, but I can assure you that it is not being released as GPL and permission was obtained from the contributors of the content used (engine, qc, map sources - all art/sound assets are being redone from scratch).

The game is coming to PS3.

The audience for console Nexuiz is entirely separate from GPL Nexuiz (most of the GPL Nexuiz players do not like using gamepads), there should be no conflict or overlap other than some marketing confusion (as is normal when two games share a name and website).

GPL Nexuiz development will proceed as usual and this should not affect it in any way, Illfonic has licensed the relevant materials and name with no intention of interfering with the GPL Nexuiz development.

Any contributions to GPL Nexuiz do not have any bearing on the new Nexuiz game, there is no chance of being "ripped off", individual permission must be obtained (as dictated by copyright law).

As far as I know the new art will not be coming back to GPL Nexuiz, as it was made specifically for this game (much like Quake Arena Arcade for Xbox360 has different art from Quake 3 Arena and Quake Live, with no return of updated art).

I have not been able to speak about this until it was unveiled, and still have to watch my wording, so I'll leave it at that.

P.S. the console Nexuiz is fun!

they got the ownership of nexuiz.com and thats already an interference, because most people will use the game name as a site and go to that console version.


Since its a total different game why dont they try to find an own name for it?

True, or let the site have an EQUAL large redirecter for console/pc Nexuiz.

Though I'm saying this the third time now, but Vermeulen at least could post something about this on the News section asap the new site came online.
I'm sorry I have to say this, but the way this was handled is a direct insult to the whole Nexuiz community, developers and players alike. An insult to those, who let's face it, made his indie developer group and his game so great and awesome.

What bugs me too is that soon we'll have to add something to the term "Nexuiz" whenever we speak of it, in order to avoid confusion. "GPL Nexuiz", or "PC Nexuiz"... Why don't they call it anything else? What's it good for to use the name Nexuiz? GPL Nexuiz (there you go... *sigh*) isn't even that much of a world famous game that the name would be of much value to them. They could have used anything. Especially if they basically do everything new from scratch.

Who has ensured that the name "Nexuiz" may continue to be used for this project once that company registered a trade mark on it?

Is there a way to ensure no GPL'ed content will be sold with this game?

You CAN sell GPL'ed content, the GPL allows it (thank God btw.). Also, you're wrong about Nexuiz isn't a world famous game. I have seen official NVidia benchmarks, where they used Nexuiz to meause and compare the performance of the new driver.

Really? I need to re-read the GPL.

Edit: ok, but they will have to release the source code of everything based on GPLed content, if I am not mistaken.

So they licensed the name "Nexuiz" and the domain nexuiz.com to be used for a new game on the Xbox.

How in the world could someone possibly think that there could be two totally separate, unrelated games named Nexuiz running on separate platforms and there be NO confusion or problems from this? It's far more than just a marketing issue. This is a punch to the gut of the existing (and struggling) Nexuiz community.

Just a thought: in the screenshot there is a button called "PC Nexuiz GPL". Maybe that leads to the current Nexuiz site. Yes, it sucks..
Anyway, I think that they made a mistake and put the site online for a short period of time. This is how that screenshot was possible (maybe).

It does. And it still doesn't make it acceptable. Currently that site seems to be more like a placeholder. Imagine when there's more content. Who scrolls down to the bottom and finds the button? Noone.

I never knew that they also took the name Nexuiz. But that is fine and good. Because the "normal" Nexuiz gets more publicity.
But I wish they had a big banner that said something like "Click here for the original free Nexuiz version".

I'm sorry, but that sounds like wishful thinking. If anything "normal" Nezuiz gets less publicity and completely forgotten. The name Nexuiz will probably be associated with the console game instead, draining and killing this wonderful community.

But I wish they had a big banner that said something like "Click here for the original free Nexuiz version".


Sounds reasonable. If it's at the top of the site and takes up at least 50% of the header.

This is awesome. And of course I'd like all of you to try it out. I know a bunch of Nexuiz users that own a ps3.


I own a PS3. I will never play this "new" Nexuiz on it. Too heretic for me.

It doesn't look like id offers commercial licenses to id tech 1 anymore, but this should be considered for console nexuiz since Darkplaces is not a clean-room implementation of Quake 1.

Well atleast the people's who's GPL content was licensed have gotten or will get some money for their contributions to opensource.
Other than the name conflict (2 games, one name), this isn't a bad thing.
It's good that those who made the game code, engine, and content and contributed it to opensource will (I assume) aquire some income for it.

GPL nexuiz will have to change it's name, however, as a practicality measure. It's an easy fix: go choose the word for "strength" or "power" in some other language.

Like german. Or russian. Or american (the american word for "strenght" is Nuke, so you could still use the N symbol powerup)

Hopefully the commercial developers will pay the game and engine code developers to add more features and let those features be GPL.
I hope this is a windfall for the nexuiz developers as ... well if one can make some income from the OSS stuff, then one doesn't have to devote one's ENTIRE life to a regular job that bars one from really doing much with OSS (sucks up all one's time).

If the name is changed just inform phorex, nvidia, and slashdot. There you go, then they'll use the new name for their benchmarks.

This is bloody awesome!

Nexuiz, the nexuiz we all love dearly, will get loads of attention!
People will see that there is a PC version and thats its GPL.

"- Dude what's the GPL?
-- Well, its a thing were people can contribute, enhance the game and freely copy/hand it out. Players make/IS the game.
- ORLY?
-- YARLY.
- So.. liek there is these two games with the same name and one you pay for and the other you get free and you can do stuff with it?
-- Yeah, its free as in you can change it to what you want, great for curriculum vitae as an dev/artist and YES free as of charge"

And so forth. Its the TALKING that matters, I mean the whole of south america and india and other FLOSS friendly bigass places and the rest of the world have a large bunch of artists and developers for nexuiz, they don't know it yet. They don't know how great of a feat it would be to have future employers look at their work, point and say, "See those guts in midair? Thats my code/graphics" That is where we as a community come in, as in being nice to newcomers, have a open friendly non elitist attitude, spawn ideas within the community, but most of all, help each other out and keep on having a good time!

Although there are two things that I might wonder about:
A: Why nexuiz and not nexuiz with something added to it. I should add that I like it the way it is now.
B: I hope they got some moneys for it thats been directed toward developers and other artists. I think that is a bigger hurdle to get people interested (STILL sadly enough), than that there is a console (good god) game out there with the same name as real nexuiz.
